Terms of Service

These terms are the agreement between you and GoldenBerry Software OÜ ("GoldenBerry", "we") for using Clementine, a native Mac email client, and this website. By downloading, installing, or using Clementine, you agree to them. If you do not agree, please do not use the app.

The short version

• Clementine is licensed to you, not sold. You own your licence and your data.
• You connect your own Google accounts and, optionally, your own AI key, and you are responsible for them.
• Use the app lawfully and don't try to break, resell, or reverse-engineer it.
• The app is provided "as is", and our liability is limited as set out below.

Your licence

Subject to these terms, we grant you a personal, non-exclusive, non-transferable licence to install and use Clementine on Macs you own or control. Clementine is sold two ways. A lifetime licence is a one-time purchase that includes the app and every update we ship, with no renewals and nothing that expires. A yearly licence includes the app and every update while it is active; it renews each year until you cancel, and you can replace it with a lifetime licence at any time. Either way, your mail and your data remain yours. You may not sell, sublicense, rent, or redistribute the app, or remove its notices.

Eligibility and your account

You must be at least 13 years old, or the age of digital consent where you live, to use Clementine. You are responsible for keeping your Mac, your Google sign-in, and any licence key secure.

Your Google connection

Clementine connects to your Google accounts with Google's official sign-in (OAuth) and acts on your behalf within the permissions you grant. Your use of Gmail and other Google services remains subject to Google's own terms. Clementine is not affiliated with, endorsed by, or sponsored by Google or Apple. You can revoke Clementine's access at any time from your Google Account security settings.

AI features and your own key

Clementine's AI features are opt-in and run only when you ask for them, using an AI provider and API key you configure. You are responsible for your use of that provider, its costs, and compliance with its terms. AI output can be inaccurate, so you are always the last set of eyes before anything is sent.

The CLI and agents

The clem CLI and MCP server run locally and act with the permissions you grant. You are responsible for any automation you set up and for what agents you allow to act on your inbox.

Acceptable use

You agree not to:

• use Clementine to send spam or unlawful, infringing, or harmful content;
• break, overload, or interfere with the app, Google's services, or any AI provider;
• reverse-engineer, decompile, or attempt to extract the source, except where the law allows;
• resell, redistribute, or share your licence beyond what these terms permit; or
• use the app in violation of any applicable law or third-party rights.

Payments and refunds

When Clementine is available to buy, prices are shown at purchase and payment is handled by the app store or processor it ships through, under that processor's own terms. Where a free trial is offered, it converts to a paid licence only if you choose to buy. A yearly licence renews automatically until you cancel with the payment processor; cancelling stops future renewals and the licence stays active until the end of the period you paid for. Refunds follow the policy of the store or processor you bought through and any rights you have under applicable consumer law.

Updates and changes to the app

We may release updates that add, change, or remove features. We may also discontinue the app, in which case any perpetual licence you hold continues to work on supported systems for as long as it reasonably can.

Intellectual property

Clementine, its name, logo, and design are owned by GoldenBerry and protected by law. These terms grant you a licence to use the app, not any ownership of it. Your mail, your accounts, and your data remain yours.

Disclaimer of warranties

Clementine is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that it will fit a particular purpose. Nothing in these terms limits rights you have that cannot be limited under applicable consumer law.

Limitation of liability

To the fullest extent permitted by law, GoldenBerry will not be liable for indirect, incidental, special, or consequential damages, or for lost data, profits, or revenue, arising from your use of Clementine. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim.

Termination

You may stop using Clementine at any time. We may suspend or end your licence if you materially breach these terms. On termination, the licence ends, but provisions that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) continue to apply.

Governing law

These terms are governed by the laws of Estonia, and disputes are subject to the courts of Estonia, without affecting any mandatory consumer-protection rights you have where you live.

Changes to these terms

If we change these terms, we will update the date above and, for material changes, note it on this page. Continuing to use Clementine after a change means you accept the updated terms.
